These Terms of Service (“Terms”) govern your use of the PenguinUGC website and services (“Service”). By using the Service or engaging us to build your portfolio, you agree to these Terms. If you do not agree, please do not use the Service.
The service
PenguinUGC is a done-for-you service that builds and hosts a portfolio (media kit) for UGC creators using content you provide, such as your videos, stats, and rates. Specific deliverables, timelines, and pricing are agreed with you before work begins.
Founding offer
Promotional pricing, including any “founding member” discount, is limited in number and time, offered at our discretion, and may be changed or withdrawn at any time before you place an order. The price confirmed to you at the time you order is the price that applies to that order.
Orders, payment, and refunds
Fees, billing frequency (one-time and any recurring hosting fees), and refund terms are set out when you order. Recurring hosting fees continue until you cancel. If you have a concern about your order, contact us and we will work with you in good faith.
Your content and responsibilities
- You retain ownership of the content you provide to us.
- You grant us permission to use that content solely to build and host your portfolio.
- You confirm you have the rights to the content you provide, that any stats you supply are accurate, and that your content does not infringe others’ rights or break the law.
Our work
The design, templates, and code we create to deliver the Service remain ours, except for your own content. We may show non-confidential examples of our work in our portfolio unless you ask us not to.
Acceptable use
You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, or use it for unlawful or deceptive purposes.
Disclaimers
The Service is provided “as is.” We do not guarantee any particular business result, such as a specific number of brand deals. We make reasonable efforts to keep hosted portfolios available but do not guarantee uninterrupted service.
Limitation of liability
To the maximum extent permitted by law, PenguinUGC is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us for the order giving rise to the claim.
Termination
You may stop using the Service at any time. We may suspend or end the Service for anyone who breaches these Terms.
Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
